These Terms of Service (“Terms”) govern your access to and use of the website located at www.softdigitalkey.com (the “Site”) and the digital software products offered thereon (the “Products”), all operated by Softdigitalkey LLC (“Softdigitalkey,” “we,” “us,” or “our”).
By accessing or using the Site or Products, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Site or Products.
- Account Creation:
1.1 To access certain features of the Site and purchase Products, you may need to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activity that occurs under your account.

3.3 You are solely responsible for your User Content and represent and warrant that you have all necessary rights to grant us the license set forth in Section 3.2.
3.4 You may not submit User Content that is illegal, obscene, defamatory, or infringes on the intellectual property rights of others. - Intellectual Property:
4.1 The Site and Products, including all intellectual property rights therein, are owned by Softdigitalkey or its licensors. This includes copyrights, trademarks, patents, trade secrets, and other proprietary rights.

5.4 WE DO NOT WARRANT THAT THE SITE OR PRODUCTS WILL BE SECURE, FREE OF VIRUSES OR OTHER MALWARE, OR ACCURATE. - Limitation of Liability:
6.1 IN NO EVENT SHALL SOFTDIGITALKEY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR PRODUCTS.
6.2 THIS LIMITATION OF LIABILITY APPLIES, WITHOUT LIMITATION, TO DAMAGES FOR LOSS OF PROFITS, DATA LOSS, BUSINESS INTERRUPTION, AND PERSONAL INJURY.
6.3 SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU. - Indemnification:
7.1 You agree to indemnify, defend, and hold harmless Softdigitalkey, its officers, directors, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site or Products, including any violation of these Terms by you. - Termination:
8.1 We may terminate your access to and use of the Site or Products at any time, for any reason, or for no reason at all, with or without notice. This may include situations where you violate these Terms, infringe on the intellectual property rights of others, or engage in conduct that we deem harmful to the Site or Products.
8.2 You may terminate your account at any time by following the instructions on the Site.
8.3 Upon termination, all rights and licenses granted to you under these Terms will terminate. We may also retain and use any User Content you have submitted to the Site in accordance with Section 3.2. - Governing Law:
9.1 These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming , United States of America, without regard to its conflict of laws principles. - Entire Agreement:
These Terms constitute the entire agreement between you and Softdigitalkey regarding your use of the Site and Products. - Severability:
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. - No Waiver:
No waiver of any breach of any provision of these Terms by Softdigitalkey shall be deemed a waiver of any subsequent breach. - Amendments:

Your continued use of the Site or Products after the amended terms are posted will be deemed your acceptance of the amended terms.
